In a significant legal development, four individuals from Assam have approached the Supreme Court seeking the registration of an FIR and the constitution of a Special Investigation Team (SIT) against Assam Chief Minister Himanta Biswa Sarma over alleged hate speech offences.
The petitioners have alleged that certain public remarks made by the Chief Minister promote communal disharmony and violate provisions of the Indian Penal Code related to hate speech and incitement. They have urged the apex court to direct authorities to initiate criminal proceedings and ensure an independent investigation into the matter.
According to the plea, the petitioners contend that despite complaints being raised, no effective action has been taken by the state police. They argue that an SIT monitored by the Supreme Court would ensure a fair and impartial probe, given that the allegations involve the sitting Chief Minister.
The petition reportedly cites constitutional provisions safeguarding equality and secularism, asserting that public officials are duty-bound to uphold these principles. It also refers to past Supreme Court rulings emphasizing strict action against hate speech and the responsibility of authorities to act promptly in such cases.
