Relief for Actor Imran Khan as High Court Halts Deportation Notice After Apology

Source Live law

Bollywood actor Imran Khan received temporary relief from the Bombay High Court on Monday. The court extended the stay on a “Leave India Notice” issued against him by immigration authorities, putting it on hold until December 7. However, the judges sternly reminded the actor that holding an Overseas Citizen of India (OCI) card does not grant him the same rights as an Indian citizen.

The court directed Imran to submit an unconditional apology and a written promise that he will not take part in political protests in the country.

Why Was Imran Khan Asked to Leave India?

The trouble began on October 10 when Imran was briefly detained by Mumbai Police near August Kranti Maidan. He was present at a demonstration protesting against the Special Intensive Revision (SIR) of voter lists. Following a complaint by BJP leader Kirit Somaiya, the Foreigners Regional Registration Officer (FRRO) served Imran a notice on October 14, ordering him to leave India by October 28. Authorities stated that as a foreign national holding US citizenship, his involvement in political protests violated immigration rules and his OCI status.

Imran approached the High Court, arguing that he had lived in India since he was two years old, built his entire acting career here, and had no criminal record. He also claimed he was not given a chance to present his side before being asked to leave the country.

Court Issues Sharp Warning on OCI Limits

During the hearing, the bench made it clear that foreign citizens cannot engage in domestic political protests. The court noted that because Imran is not an Indian voter, he had no business joining a protest regarding the revision of electoral rolls.

The judges pointed out that OCI holders live in India under specific conditions and cannot act as full citizens. The bench highlighted that as a public figure with many followers, Imran’s actions carry weight and require greater responsibility. The judges added that if an Indian national joined political protests in the United States, they would face similar strict consequences.

Following the court’s strong remarks, Imran tendered an unconditional apology and gave a formal undertaking not to participate in such protests again.

Fair Hearing and What Happens Next

While firmly rebuking the actor, the High Court also emphasized the need for fairness. The bench observed that because Imran has resided in India for over four decades, immigration officials must follow proper legal procedure and give him an opportunity to respond before making a final decision.

The order to leave India will remain suspended until the FRRO reviews Imran’s formal explanation. The High Court will take up the case again on December 7 to examine the authorities’ response.
