Court Denies Bail to Luthras; Thailand Prepares for Deportation of Goa Nightclub Owners

NEW DELHI/PHUKET: In a major setback for the owners of the Goa nightclub embroiled in a deadly fire tragedy, a Delhi court on Thursday rejected the transit anticipatory bail plea of Saurabh and Gaurav Luthra. The denial comes just hours after the brothers, who had fled to Thailand following the inferno that claimed 25 lives, were detained by Thai police, and authorities confirmed that deportation proceedings are now being expedited.

The Luthras, co-owners of the ill-fated ‘Birch by Romeo Lane’ in North Goa’s Arpora, were detained in Phuket following an Interpol Blue Corner Notice issued at the request of Indian law enforcement agencies.

Bail Plea Dismissed

Additional Sessions Judge Vandana of the Rohini Courts delivered the order, refusing to grant the brothers protection from immediate arrest upon their return to India. The prosecution vigorously opposed the bail application, arguing that the timing and nature of the brothers’ departure indicated a clear attempt to “evade the legal process” and investigation.

Prosecution Stance: It was argued that the Luthras booked flight tickets to Phuket at 1:17 am on December 7, just over an hour after the fire broke out, suggesting they fled while emergency services were still struggling to control the blaze and rescue the trapped.

Defence Argument: The brothers’ legal counsel contended that they were willing to return immediately and face the probe, claiming they had travelled to Thailand for legitimate business purposes, not to escape the law. The defence also argued that, as they were not present at the club at the time of the incident, they should not be held directly criminally liable for the deaths.

However, the court sided with the prosecution’s view that such discretionary relief could not be granted to those who appeared to have sought to evade the law.

Deportation Imminent

With the Delhi court denying any relief, the focus now shifts entirely to the process of bringing the accused back to India. Government sources indicate that Thai authorities are fast-tracking the deportation of Saurabh and Gaurav Luthra, who are currently in their custody.

Detention: The brothers were detained in Phuket earlier on Thursday.

Passport Suspension: The Ministry of External Affairs had earlier suspended their passports, preventing them from travelling further from Thailand.

Next Steps: A team of Goa Police is reported to be preparing to leave for Thailand to complete the necessary paperwork and take custody of the accused, who face charges including culpable homicide not amounting to murder and negligence in connection with the fire.

Goa Chief Minister Pramod Sawant confirmed the detention and stated that all efforts are being coordinated with the Central Bureau of Investigation (CBI) and the Ministry of External Affairs to ensure the Luthras are brought back to the country at the earliest. The tragic incident, which saw 25 people lose their lives, has led to intense scrutiny of safety regulations and operational permits for entertainment venues across the coastal state.
