Source Bar and Bench
The Kerala High Court on Tuesday ordered a temporary stay on the release of the film The Kerala Story 2, directing the Central Board of Film Certification (CBFC) to re-examine objections raised against the movie.
The court’s interim order came while hearing petitions challenging the film’s certification and alleging that certain scenes and dialogues could potentially disturb communal harmony and public order. Petitioners argued that the sequel, like its predecessor The Kerala Story, contains controversial themes that require closer scrutiny before public screening.
During the proceedings, the bench observed that while creative freedom is protected under the Constitution, it must be balanced with concerns of law and order and social sensitivity. The court asked the CBFC to review the specific grievances mentioned in the plea and submit its response within a stipulated timeframe.
Counsel appearing for the filmmakers contended that the movie had already undergone the certification process and that due procedure was followed. They maintained that the film does not intend to hurt any community and is based on fictionalized narratives.
The state government informed the court that it is closely monitoring the situation and will ensure that peace and public order are maintained.
Until the CBFC completes its review and the court takes up the matter again, the release of The Kerala Story 2 will remain on hold in Kerala.
The case is scheduled for further hearing later this week.
