SEBI Simplifies Share Transfer Process for Legal Heirs

In a significant move aimed at protecting investor interests and reducing procedural hurdles, the Securities and Exchange Board of India (SEBI) has introduced a streamlined mechanism to facilitate the transfer of shares to the legal heirs of deceased investors.

The new framework is designed to make the transmission process faster, more transparent, and less cumbersome for beneficiaries who often face delays due to complex documentation and verification requirements. Under the revised guidelines, SEBI has eased norms for submission of documents and clarified procedures for both listed companies and intermediaries such as depositories and registrars.

One of the key highlights of the reform is the introduction of standardized documentation requirements, which will help eliminate inconsistencies across institutions. In cases where the value of shares is below a specified threshold, legal heirs may now benefit from simplified processes that require fewer legal formalities, such as succession certificates or probate.

SEBI has also encouraged the use of digital platforms to process claims, allowing faster verification and reducing the need for physical paperwork. This move is expected to significantly cut down processing time and improve efficiency.

Market participants have welcomed the initiative, stating that it will provide much-needed relief to families dealing with financial assets after the loss of a loved one. Experts believe the reform will not only enhance investor confidence but also reduce the number of unclaimed financial assets in the system.

The regulator emphasized that the changes are part of its broader effort to improve ease of doing business in the securities market while ensuring investor protection remains a top priority.

With these measures in place, SEBI aims to create a more investor-friendly ecosystem that ensures rightful ownership of securities is transferred smoothly and without unnecessary delays.
